Tiny FrontierTerms of Service
These Terms of Service ("Terms") are an agreement between you and Emberly Apps ("we", "us", "our") about your use of the Tiny Frontier game, website and related services (the "Game"). By installing or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
1. Who may play
You must be at least 13 years old to play. If you are under the age of majority where you live, a parent or guardian must agree to these Terms on your behalf and is responsible for your use, including any purchases.
2. Your licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own entertainment and in accordance with these Terms and the rules of the app store you got it from. The Game is licensed, not sold.
3. Accounts and progress
You can play without an account. If you sign in with Google, you are responsible for keeping that account secure. Your progress may be stored on our servers so it can be restored or merged across devices; we aim to keep it safe but cannot guarantee that saved progress will never be lost. You may delete your account and data at any time from Settings or via this page.
4. Virtual items and purchases
- Coins, tools, hearts, extra moves and other in-game items ("Virtual Items") are a limited licence to features within the Game. They have no monetary value, cannot be exchanged for money or anything of value outside the Game, and cannot be transferred or sold.
- Purchases are made through Google Play or the Apple App Store under their terms. Prices are shown before you confirm. Refunds are handled by the store according to its policy; we cannot issue refunds directly.
- Purchases of consumable items (such as coin packs) are used up when spent. Non-consumable purchases (such as No Ads or the Founder's Pack) are tied to your store account and can be restored from the Trading Post on any device signed in to that store account.
- We may change, rebalance, or discontinue Virtual Items and game content from time to time. We will not remove a non-consumable item you paid for without providing a reasonable equivalent.
5. Advertising
The Game may show ads, including optional rewarded videos that grant Virtual Items when watched to completion. Rewards are granted only when the ad network confirms the view. Buying No Ads removes interstitial ads but rewarded ads remain available by choice.
6. Fair play and conduct
You agree not to:
- cheat, use bots, exploits or modified clients, or manipulate the leaderboard;
- choose a settler name that is offensive, impersonates someone, or infringes anyone's rights (we may rename or remove entries);
- reverse engineer, copy, resell or redistribute the Game or its assets except as the law permits;
- interfere with the Game's servers or other players' use.
We may suspend or terminate access, reset progress or remove leaderboard entries for violations. If we terminate your access for a violation, you are not entitled to a refund of any purchase.
7. Our content
The Game, including its art, music, code, characters, names and text, is owned by Emberly Apps or its licensors and protected by copyright and other laws. You may share screenshots and videos of your play for non-commercial purposes, with credit to Tiny Frontier.
8. Changes and availability
We may update the Game, add or remove features, and change balance values at any time. Online features such as cloud save and the leaderboard depend on third-party services and may be unavailable from time to time. We may discontinue the Game with reasonable notice.
9. Disclaimer of warranties
The Game is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Game will be uninterrupted, error-free or that saved progress will never be lost.
10. Limitation of liability
To the fullest extent permitted by law, Emberly Apps will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, progress or Virtual Items, arising from your use of the Game. Our total liability for any claim relating to the Game will not exceed the amount you paid us in the twelve months before the claim, or US $50, whichever is greater. Some jurisdictions do not allow these limitations, so they may not apply to you.
11. Indemnity
You agree to indemnify and hold Emberly Apps harmless from claims arising out of your breach of these Terms or misuse of the Game.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction. If you live in the European Union or United Kingdom, you keep the protections of the mandatory consumer laws of your country of residence.
13. Apple and Google
If you obtained the Game from the Apple App Store, you acknowledge that these Terms are between you and Emberly Apps, not Apple; Apple has no obligation to provide support or maintenance; and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them. Google Play's terms apply to purchases made there.
14. General
These Terms are the entire agreement between you and us about the Game. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor.
15. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the Game. Continued play after a change means you accept the new Terms.
